Forums Terms of Use

For the purposes of this agreement "services" will refer to any communication resource, community forum, social networking tool or related web application offered on the Green Diva Enterprises family of websites.  "Green Diva," also referred to as "provider," will refer to all Green Diva Enterprises companies, subsidiaries, sister companies, DBAs, employees, owners and partners.

By signing up and/or accessing Green Diva services you are agreeing to be bound by terms of this agreement. Please read this document carefully as it is a legally binding agreement. If you do not agree to be bound by the terms of this agreement, you may not use the services we provide. These services are intended for use only by individuals who are at least 18 years old or minors 13 years old and above who have parental permission. Green Diva Enterprises reserves the right to change the terms, conditions, and notices at any time, and such modifications shall be effective immediately upon posting of such changes. You are therefore responsible for regularly reviewing these Terms of Service and additional terms or notices posted on the Green Diva website. To use our services you must agree to all of the following:

Indemnification
You must understand and agree that service provided is provided "as is" and "as available". Green Diva makes no warranties of any kind regarding any service provided. Green Diva makes no claim that any service provided will meet your requirements, will be uninterrupted, timely, secure, or error-free. No information obtained from a third party is endorsed by Green Diva and remains the responsibility of the third party providing the information. The provider gives no warranty, expressed or implied, for the services provided, including, without limitation, warranty of merchantability and warranty of fitness for a particular purpose. This warranty expressly includes any reimbursement for losses of income due to disruption of service by the provider or its providers beyond the fees paid by client to provider for services. We make every effort to backup our data, but we are not responsible for any loss of data. In no event shall Green Diva be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Green Diva harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Green Diva, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Green Diva is not responsible for any content hosted on our network of forums and communication applications.

Green Diva websites
By using our services you agree to be bound by and comply with any and all applicable laws, regulations, ordinances or other such requirements of any applicable Federal, State or local government. Forums and other communication applications MAY NOT contain any of the following, including but not limited to:
-Adult Content / Obscene Content
-Harassment
-Illegal Drugs
-Terrorism
-Piracy, Hacking, Viruses
-Racism/Hate/Derogatory/Slanderous
-Promotion of or distribution of copyrighted materials which includes but is not limited to, the following:
     -links to download pirated movies, software, games etc from megaupload, rapidshare, and other such hosts/FTP/private servers
-Malicious software
-Non Green Diva sponsored ads

It is up to the forum user to be responsible for upholding these rules on his/her posts.

Green Diva will be the deciding factor in what is allowed and not allowed. Green Diva's failure to insist upon or enforce strict performance of any provision of these Terms of Service shall not be construed as a waiver of any provision or right. If your forum content is found to be in violation of these terms, your posts will be permanently removed, and any applicable legal actions shall also be taken if needed. Green Diva unconditionally reserves the right to remove or suspend access to the forums without notice or explanation. Failure to abide by any local, state, or federal laws regarding the forum (s) will result in permanent removal and refusal of service. Green Diva will not be held responsible for any content and/or damages caused by such material hosted on our network.

If you, as a user and participant, at any time become aware of inappropriate content on the Green Diva forums and through other communication tools and web applications, you are advised to notify Green Diva immediately at info@greendivajewelry.com.  Additionally, if you are exposed to content on the Green Diva forum and communication network which you find offensive or harmful in any way, you have the explicit right to cease all reading and exposure to said content and exit the website and other communication areas at once.  Green Diva shall, under no circumstances, be held liable for any offense you take or harm you incur from content hosted on our communication platforms and forum networks.

By signing up to our services you are subscribed to receive service announcements that relate to your agreement with Green Diva.  You are also agreeing to receive news, tips and other information from Green Diva Enterprises companies, of which you may unsubscribe at any time by clicking the "unsubscribe" link at the bottom of any email communication you receive from Green Diva.  At times, this may also include communications from partners, sponsors and other affiliates that support the forum and communication services offered through the Green Diva family of websites.

User Content & Contact Information
By using the services referred to herein, you agree to allow display of the name or alias and avatar of your choosing, which will be available for viewing to the general public.  You understand and agree that all content which you submit is available for viewing by the general public and will be indexed by all search engines choosing to access such content.  You agree to hold Green Diva harmless for any losses or damages incurred by you due to submitting content to our forum and communication networks.

Legal Disputes
In the event it is necessary to refer any dispute to an attorney or resolve it in a court of law, the prevailing party will be entitled to an award of reasonable attorney's fees and all costs associated with any legal action, whether or not a suit shall actually be filed. These terms of service shall be governed by and construed in accordance with the laws of the respective states of the owners and the United States of America.

Service Availability
Green Diva does not, at any time, guarantee the availability of services and shall not be held liable for any losses or interruptions experienced by users as a result of service unavailability. 

Green Diva Upgrades and Advertising
Green Diva reserves the right to upgrade or change forum, communication and web services at any time.  Green Diva also reserves the right to post advertising on its website, which may appear on public or community forums and networking areas.

Copyright and Licenses
The entire contents of the Green Diva family of websites are property of Green Diva, including but not limited to: text, graphics, logos, buttons, icons, audio clips, and any other data form. You may not reproduce, modify, copy, republish, or transmit/distribute, any portion of the website without the prior express written consent of Green Diva. Your submission of any file hereby constitutes your agreement to grant Green Diva a non-exclusive, royalty-free, worldwide, sub-licensable, perpetual license, to reproduce, distribute, transmit, modify, adapt, sub-license, and publicly display any such submissions. You also grant Green Diva the right to utilize your name in connection with all advertising, marketing and promotional materials related thereto. Green Diva will enforce its intellectual property rights to the fullest extent of the law.

Entire Agreement
This policy operates alongside the Website Terms and Conditions, Privacy Policy , Terms of Purchase and Return Policy.
